The content provided through the Briefdex Finance application, including all audio briefings, scripts, market summaries, and commentary, is produced using artificial intelligence and is provided for general informational and educational purposes only.

Nothing in the Briefdex Service constitutes financial advice, investment advice, trading advice, or any other form of advice regulated under the Financial Markets Conduct Act 2013 (New Zealand) or the Corporations Act 2001 (Australia). Briefdex Finance is not a licensed financial adviser, broker, or investment service provider.

You should not make any financial or investment decision based solely on content heard in a Briefdex briefing. Always seek advice from a qualified and licensed financial adviser before making investment decisions.

These Terms of Service ("Terms") govern your access to and use of the Briefdex Finance mobile application and related services ("Service") provided by Briefdex Finance ("Briefdex", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to create an account and use the Service. By agreeing to these Terms, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.

The Service is available to users in New Zealand and Australia. By using the Service, you confirm that your use complies with all laws and regulations applicable in your jurisdiction.

2. Your Account

To access the Service you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and current information when creating your account and to update that information if it changes. You must notify us immediately at hello@briefdex.com if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms or if your account has been compromised.

3. Subscriptions and Billing

3.1 Free Trial

New users are offered a 7-day free trial upon first sign-up. The free trial gives you full access to all features of the Service. At the end of the 7-day trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends. You will not be charged during the trial period.

3.2 Paid Subscription

Following the free trial, continued access to the Service requires a paid subscription. Subscription fees are billed on a monthly basis through Apple In-App Purchase. By subscribing, you authorise Apple to charge your nominated payment method on a recurring monthly basis.

3.3 Cancellation

You may cancel your subscription at any time through your Apple ID subscription settings. Cancellation takes effect at the end of your current billing period. Upon cancellation, you will retain full access to the Service until the end of the period for which you have already paid. No partial refunds are issued for unused days within a billing period.

For example, if your monthly billing date is the 1st of the month and you cancel on the 15th, your access will continue until the end of that month. You will not be charged again after cancellation.

3.4 Price Changes

We reserve the right to change subscription pricing. If we increase the price of your subscription, we will provide you with at least 30 days advance notice by email. Your continued use of the Service after the price change takes effect constitutes your acceptance of the new price.

3.5 Refunds

All purchases are processed by Apple. Refund requests are subject to Apple's refund policy. We do not process refunds directly. To request a refund, contact Apple Support at reportaproblem.apple.com.

4. Nature of Content — AI-Generated Briefings

All audio briefings and scripts delivered through the Service are generated using artificial intelligence, including large language models and text-to-speech technology. While we take reasonable steps to ensure accuracy, AI-generated content may contain errors, omissions, outdated information, or inaccuracies.

Briefdex briefings are produced from publicly available data sources including government publications, company announcements, and market data feeds. The content reflects information available at the time of generation and may not reflect subsequent developments.

You acknowledge that:

  1. the content is AI-generated and has not been reviewed or verified by a licensed financial adviser;
  2. market data, prices, and statistics included in briefings are sourced from third-party data providers and may contain errors;
  3. the content is for informational purposes only and does not constitute financial advice; and
  4. you will not make investment or financial decisions based solely on content heard in a Briefdex briefing.

5. Not Financial Advice

Briefdex Finance is not a financial advice provider, investment adviser, broker, or dealer. Nothing in the Service constitutes a recommendation to buy, sell, or hold any financial product, security, or asset.

The Service does not take into account your individual financial situation, objectives, or risk tolerance. Any financial or investment decision you make based on information heard in a Briefdex briefing is made entirely at your own risk.

In New Zealand, financial advice is regulated under the Financial Markets Conduct Act 2013. In Australia, financial advice is regulated under the Corporations Act 2001. Briefdex Finance does not hold a licence under either Act to provide financial advice.

We strongly encourage you to seek advice from a qualified and licensed financial adviser before making any investment or financial decisions.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  1. reproduce, distribute, republish, or resell any content from the Service without our prior written consent;
  2. record, download, or extract audio from the Service for any commercial purpose;
  3. use automated tools, bots, or scrapers to access or collect data from the Service;
  4. attempt to reverse engineer, decompile, or extract source code from the app;
  5. use the Service in a way that could damage, disable, or impair our systems or infrastructure;
  6. share your account credentials with any other person; or
  7. use the Service in any way that violates applicable laws or regulations.

7. Intellectual Property

All content delivered through the Service, including audio briefings, scripts, branding, design, and software, is owned by or licensed to Briefdex Finance. Nothing in these Terms grants you any ownership right or licence in our intellectual property beyond the limited right to use the Service for your personal, non-commercial purposes during an active subscription.

The Briefdex name, logo, and product marks are the property of Briefdex Finance. You must not use them without our prior written consent.

8. Availability and Service Changes

We aim to deliver the Service every weekday morning. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control including data source failures, third-party outages, or public holidays.

We reserve the right to modify, suspend, or discontinue the Service or any feature of it at any time. Where we make material changes that affect your use of the Service, we will provide reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, Briefdex Finance and its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on the Service, including but not limited to any financial loss arising from investment decisions made in reliance on content heard in a briefing.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total subscription fees paid by you in the three months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the Consumer Guarantees Act 1993 (New Zealand) or the Australian Consumer Law.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations, express or implied, regarding the Service, including as to accuracy, completeness, reliability, fitness for a particular purpose, or non-infringement.

We do not warrant that the content of any briefing is accurate, complete, or up to date, or that the Service will be free from errors or interruptions.

11. Termination

You may terminate your account at any time by cancelling your subscription and contacting us at hello@briefdex.com to request account deletion.

We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms, if we are required to do so by law, or if we reasonably believe your account has been compromised or used fraudulently.

Upon termination, your right to use the Service ceases immediately. Sections 5 (Not Financial Advice), 7 (Intellectual Property), 9 (Limitation of Liability), and 13 (Governing Law) survive termination.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, available at briefdex.com/privacy-policy.html. By using the Service, you agree to the collection and use of your information as described in the Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of New Zealand. For users in Australia, to the extent required by Australian Consumer Law, Australian law applies to your statutory consumer rights.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed by contacting us at hello@briefdex.com. We will make reasonable efforts to resolve disputes informally within 20 working days.

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts of New Zealand, except where applicable law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email to the address associated with your account or by a prominent notice within the app at least 14 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically. The date at the top of this page indicates when the Terms were last updated.
